UVJETI PRUŽANJA USLUGE
1. Opće odredbe
Ovim Uvjetima poslovanja utvrđuju se pravila i uvjeti pod kojima EMCREATIVE, obrt za usluge i trgovinu, vl. Erik Mapilele, Sesvete, pruža usluge i prodaje proizvode putem web trgovine. Kupcem se smatra svaka pravna ili fizička osoba koja putem web trgovine naruči i plati barem jedan proizvod.

3. Cijene i porezi
Sve cijene u web trgovini istaknute su u eurima (€). Sukladno članku 90. stavku 2. Zakona o porezu na dodanu vrijednost (PDV), obrt nije u sustavu PDV-a te se PDV ne obračunava na istaknute cijene. Istaknute cijene su konačne cijene koje kupac plaća u trenutku završetka narudžbe. Troškovi dostave nisu uključeni u cijenu proizvoda i jasno su iskazani prije same potvrde kupnje.
4. Postupak kupnje i načini plaćanja
Kupnja se obavlja odabirom proizvoda, dodavanjem u košaricu te unosom podataka potrebnih za dostavu i naplatu. Web trgovina podržava sljedeće načine plaćanja:
Plaćanje platnim karticama (sigurna online transakcija putem Stripe/Shopify Payments integracije).
Nakon uspješno izvršene uplate, kupac će na navedenu e-mail adresu primiti potvrdu narudžbe, a zakonski, fiskalizirani račun bit će poslan u elektroničkom obliku najkasnije prilikom slanja ili isporuke robe.
5. Dostava i rokovi
Proizvodi se dostavljaju na adresu kupca putem odabrane dostavne službe s kojom obrt surađuje. Rokovi dostave ovise o adresi primatelja i uobičajenim rokovima dostavne službe. Obrt ne odgovara za kašnjenja uzrokovana višom silom ili propustima dostavne službe. Ako se dostava vrši izvan Europske unije, kupac je samostalno odgovoran za podmirivanje eventualnih lokalnih uvoznih davanja i carina.
6. Pravo na jednostrani raskid ugovora (Povrat i reklamacije)
Sukladno Zakonu o zaštiti potrošača, kupac ima pravo jednostrano raskinuti ugovor o kupnji u roku od 14 dana od dana preuzimanja proizvoda.
Da bi ostvario ovo pravo, kupac mora obavijestiti obrt pisanim putem (e-mailom na sales.streetartstyle@gmail.com) prije isteka roka od 14 dana.
Kupac je dužan izvršiti povrat robe o svom trošku, neoštećenu i u originalnoj ambalaži.
Iznimka: Pravo na jednostrani raskid ugovora isključeno je kod proizvoda koji su izrađeni po narudžbi, koji su personalizirani ili jasno prilagođeni specifičnim zahtjevima kupca (npr. jedinstveni tisak ili dizajn izrađen isključivo za tog kupca).
Nakon primitka i provjere vraćene robe, obrt će izvršiti povrat uplaćenog iznosa najkasnije u roku od 14 dana od dana primitka robe.
7. Zaštita osobnih podataka (GDPR)
EMCREATIVE se obvezuje štititi privatnost i osobne podatke kupaca sukladan Općoj uredbi o zaštiti podataka (GDPR). Svi podaci prikupljeni tijekom narudžbe koriste se isključivo u svrhu ispunjenja ugovora o kupnji, dostave paketa i računovodstvenih obveza te se neće ustupati trećim stranama, osim dostavnoj službi i sustavu za izdavanje računa.

1. General Provisions
These Terms of Service establish the rules and conditions under which EMCREATIVE, obrt za usluge i trgovinu, vl. Erik Mapilele, Sesvete, provides services and sells products through this online store. A Buyer is considered to be any legal or natural person who orders and pays for at least one product through the online store.

3. Prices and Taxes
All prices in the online store are displayed in Euros (€). In accordance with Article 90, Paragraph 2 of the Croatian Value Added Tax Act (Zakon o PDV-u), the business is not registered for VAT, and no VAT is charged on the displayed prices. The displayed prices are final and represent the total amount the Buyer pays at checkout. Shipping costs are not included in the product price and will be clearly displayed before the final confirmation of purchase.
4. Purchase Process and Payment Methods
The purchase is completed by selecting products, adding them to the cart, and entering the information required for delivery and billing. The online store supports the following payment methods:
Credit and Debit Cards (secure online transaction integrated via Stripe/Shopify Payments).
After a successful payment, the Buyer will receive an order confirmation via e-mail. A legally compliant, fiscalized invoice will be sent electronically no later than at the time of shipment or product delivery.
5. Shipping and Delivery
Products are delivered to the Buyer's address via the selected courier services. Delivery times depend on the recipient's address and the standard delivery terms of the shipping provider. The business is not liable for delivery delays caused by force majeure or courier faults. If shipping takes place outside the European Union, the Buyer is solely responsible for clearing customs and paying any local import duties, taxes, or handling fees.
6. Right of Withdrawal (Returns and Claims)
In accordance with the EU Consumer Rights Directive and the Croatian Consumer Protection Act, the Buyer has the right to withdraw from the purchase contract within 14 days of receiving the goods.
To exercise this right, the Buyer must notify the business in writing (via e-mail to sales.streetartstyle@gmail.com) before the 14-day period expires.
The Buyer is obliged to return the goods at their own expense, undamaged, unused, and in the original packaging.
Exception for Print-on-Demand: The right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalized (e.g., custom apparel, unique prints, or items manufactured on-demand specifically based on the Buyer's selection).
Upon receiving and inspecting the returned goods, the business will refund the full amount paid no later than 14 days from the date the returned goods were received.
7. Privacy and Data Protection (GDPR)
EMCREATIVE is committed to protecting the privacy and personal data of Buyers in accordance with the General Data Protection Regulation (GDPR). All data collected during the ordering process is used strictly for fulfilling the purchase contract, package delivery, and legal accounting requirements. Data will not be disclosed to third parties, except for the delivery service and the invoicing system.
